Update Regarding 2022 School Tax Credit

What?

While performing the final tax settlement, Village Staff and Wisconsin Department of Revenue identified an error in the Village of Fox Point State School Tax Levy Credit (STLC). After review, the State School Tax Levy Credit granted to Village taxpayers was found to be twice the finalized amount meaning Village of Fox Point taxpayers received twice the school tax levy credit to which they were entitled in the tax year 2022. Notice was given to the Village Board on September 12 along with a memo from the Village Manager with more detail.

Why?

Fox Point is one of the first six Milwaukee County municipalities transitioning to LandNav software for taxes. Once the conversion was complete, no prior year histories were available. During tax bill preparation, the Village Treasurer’s office added all the schools, as directed by LandNav staff. 

The calculation mistake was made by including Nicolet in addition to Fox Point Bayside and Maple Dale Indian Hill. Including Nicolet gave 2022 tax year owners twice the (entitled) state tax levy credit in the tax year 2022.

How Will This Be Fixed?

DOR has determined the correction should be made pursuant to the following Wisconsin Statutes: 

  • Sec. 79.175- Excess tax credit corrections.  If a municipality applies excess tax credits on the tax roll under s. 79.10 (9), the municipal clerk shall correct the excess application by deducting the excess amount from the appropriate credits in the following year.
  • Sec. 79.18- Insufficient tax credit corrections. If a municipality applies excess tax credits on the tax roll under s. 79.10 (9), the municipal clerk shall correct the deficiency by adding the deficient amount to the appropriate credits in the following year.

Village of Fox Point will address the state tax levy credit error on the 2023 taxes by subtracting the doubled 2022 amount from the 2023 state levy school tax credit, which typically increases each year. This means that the 2023 state levy school tax credit will be smaller this year
